E L I G I B I L I T Y 

ALL defendants MUST obtain one of the below eligibility assessments with results indicating the individual is eligible for Community Sentencing PRIOR to sentencing: 

  • LSI – Eligible with a score of 19 or higher 

    • Order to Conduct Assessment for Community Sentencing should be filled out and signed 

    • LSI will cost the defendant $75 unless the box indicating ‘CS Funds’ is checked on the Order to Conduct Assessment for Community Sentencing 

    • The LSI will be administered at TEEM (1501 N Classen Blvd.) or in the Oklahoma County Jail for defendants who are in custody 

  • Offender Screen (ORAS) – Eligible if Community Sentencing is listed as a recommendation 

    • Offender Screens are conducted by NorthCare free of charge 

    • Offender Screens are also conducted in the Oklahoma County Jail 

*Community Sentencing cannot supervise misdemeanor cases, per statute 
*Community Sentencing cannot supervise a defendant who is required to register as a sex offender
 

S E N T E N C I N G 

Needed Paperwork: All of the below documents are required, even if the defendant was previously sentenced and is being transferred to Community Sentencing supervision in lieu of acceleration/ revocation 

  • LSI or Offender Screen indicating the defendant is eligible for Community Sentencing 

    • ALWAYS check for eligibility first! 

  • Supplemental Order (Exhibit A) 

  • Rules & Conditions of Supervised Probation (Exhibit B) 

  • Community Sentencing Probation Plan listing the probation requirements for the defendant, often includes all the recommendations of the LSI or Offender Screen. 

Intakes are conducted in the Oklahoma County Public Defender's Office OR at TEEM (1501 N Classen Blvd.) 

how to use Community Sentencing Revocations/accelerations

Community Sentencing can supervise: 

  • Suspended sentence = maximum 3 years from date of sentence (22 O.S. § 988.22) 

  • Deferred sentence = maximum 18 months from date of sentence (22 O.S. § 991c) 

UNLESS an application to revoke or accelerate is at issue and the defendant is re-ordered to Community Sentencing supervision. 

Paperwork you need to re-order:

  1. A Court Minute stating “The defendant is re-ordered to Community Sentencing” (Do NOT simply write "readmit"!) 

  2. A new Community Sentencing Probation Plan 

  3. A new Exhibit B (Rules & Conditions of Supervised Probation) 

RE-ORDER FOR A DEFERRED SENTENCE: 

If you re-order or transfer supervision for a deferred sentence to Community Sentencing and more than 18 months have passed since the original sentencing date, supervision can only continue as long as the Application to Accelerate remains active; when it is dismissed, Community Sentencing will stop supervision. 

RE-ORDER FOR A SUSPENDED SENTENCE: 

The re-order paperwork will re-start their 3 years of program eligibility regardless of whether the Application to Revoke is dismissed as long as they are still within the time allotment of the original suspended sentence. 

PAPERWORK YOU NEED TO TRANSFER FROM PROBATION TO COMMUNITY SENTENCING: 

  • LSI or Offender Screen indicating the defendant is eligible for Community Sentencing 

  • A Court Minute stating the supervision is transferred to Community Sentencing 

  • A Community Sentencing Probation Plan 

  • A new Exhibit B (Rules & Conditions of Supervised Probation)
